FLIPBOOK.TV "BEST FLIPBOOK" CONTEST 2009-2010
OFFICIAL RULES
Participation in this contest constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules. The flipbook.tv "Best Flipbook" Contest 2009-2010 ("Contest") begins at 12:00:01 a.m. Eastern Standard Time ("EST") on December 25, 2009, ends 11:59 p.m. EST on February 8, 2010 ("Contest Period") and is sponsored by flipbook.tv ("Sponsor"). Submissions uploaded after Contest Period will not be judged. Winners will be selected and notified by e-mail between February 8, 2010 and March 1, 2010. All Winners will be announced on March 1, 2010 and will be posted on the website http://flipbook.tv/.
Eligibility: Any individual registered with flipbook.tv who uploads a flipbook movie marked public during the contest period is eligible to enter, and is automatically entered into the contest. Users of flipbook.tv that do not wish to be automatically included in the contest must opt out by sending an "opt out" request via Sponsor's contact form.
Only the original author who created the created the submission is qualified to enter and win. In the event of a dispute as to authorship, Sponsor reserves the right to disqualify any entry or winner. All of Sponsor's decisions are final.
Employees, officers and agents of Sponsor, its parent company, affiliates, subsidiaries, advertising, and promotional agencies, their immediate family members and persons living in their same household, are not eligible to participate in the Contest. All federal, state and local laws and regulations apply.
How to Enter: To enter, review the requirements posted here, and upload an original flipbook to flipbook.tv during the Contest Period. The content of the flipbook must be family-friendly (i.e., if it were a movie, it would be rated G, PG or PG-13). All content of the movies must be the entrant's original work and creation, executed solely by the entrant. The content of the movie must not be subject to the rights of any third parties, other than Sponsor. The content may not be offensive or otherwise unsuitable for Sponsor, as determined in Sponsor's sole discretion. Entries not complying with these requirements will be disqualified. By participating in the Contest, you are granting Sponsor an irrevocable right and license to publish, use, edit and display any or all of the content in your submission, without future approval, without territorial, time, or other limitations, for any and all purposes, including, but not limited to, marketing, advertising, and promotional purposes. All movies or portions thereof used by Sponsor, will be credited to the original author.
Determination of Winner: Eligible entries will be judged by a panel of judges consisting of members of the flipbook.tv team and will be judged according to the criteria set forth below. The Following criteria will be used in determining a ranking of the top submissions: popularity of the movie, as determined by the ratio of number of "likes" to the number of "views" as indicated on flipbook.tv; creativity; effective use of the medium; and entertainment value. Drawing quality may constitute a secondary level criterion if necessary.
There is no limit to the number of entries per person.
Description of Prizes: One (1) First Prize winner will receive $500.00USD. One (1) Second Prize winner will receive $250.00USD. One (1) Third Prize winner will receive $100.00USD.
General Terms and Conditions: By participating in the Contest, entrant agrees that under no circumstances, including, but not limited to, negligence, shall sponsor, its officers, directors, employees, and assigns be liable for any direct, indirect, incidental, special, or consequential damages arising out of participation in the Contest, even if any or all of the Released Parties have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, therefore these exclusions may not apply to you. By entering in the Contest, each entrant agrees to be bound by these Official Rules and the decisions of Sponsor, which shall be final. Sponsor reserves the right to disqualify any person, entry, or e-mail address that Sponsor determines to be in violation of any term contained in these Official Rules. Sponsor, its parent companies, affiliates, subsidiaries, advertising, promotion and legal advisors, and the respective employees, officers, directors, shareholders, agents, and representatives of each, are not responsible for and shall not be liable for: (i) late, delayed, misdirected, incomplete, illegible, or unintelligible entries; (ii) electronic, hardware or software program, network, Internet, or computer malfunctions, failures, interruptions or difficulties of any kind; (iii) failed, incomplete, garbled, or delayed computer transmissions; (iv) any condition caused by events beyond the control of the Sponsor that may cause the Contest to be disrupted or corrupted; or (v) any errors in any materials associated with the Contest Sponsor reserves the right to cancel, suspend, and/or modify the Contest if any problem corrupts the administration, security, or operation of the Contest, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual if it finds that individual to be tampering with the entry process or the operation of the Contest or to be acting in a violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Disputes: This Contest is governed by the laws of the United States and the State of California. Entrant agrees that any and all legal or administrative actions or proceedings related to the Contest shall be exclusively brought in the County of Contra Costa, State of California (if under state law) or the Northern District of California (if under federal law), and the parties hereby waive any defenses based upon venue, inconvenience of the forum, lack of personal jurisdiction, sufficiency of service of process or other like defenses in any such action or suit brought in the State of California. In the event an action is filed against Sponsor, and Sponsor prevails in the outcome, Sponsor is entitled to its attorneys' fees and costs expended in the matter.
Winner List: A winners list will be posted on the web site at http://flipbook.tv/ at the conclusion of the Contest.
